Court orders city to tear down Newcomb Boulevard fence, the Lens reports

New Orleans drivers will once again be free to use Newcomb Boulevard as a throughway to get from St. Charles Avenue to Freret Street after the state Fourth Circuit Court of Appeals ordered the city Monday to tear down a fence blocking one end of the Uptown Road, according to the Lens.


The fence was erected in 2006 after members of the Newcomb Boulevard Association complained about the traffic.

"They did so after a Nagin administration official said they could do so, without a public hearing or City Council approval," the Lens reported. "Adam Swensek, an assistant city attorney, said in an email Thursday that he has instructed the city's Department of Public Works to remove it 'without delay.' He estimated 'it may take a few days to get the appropriate work orders and crews in place.'"
